EU L-Category classification under Regulation (EU) No 168/2013 is decided by design speed, continuous rated power and wheel count, not by the name a supplier puts on the product. A two-wheeler limited to 45 km/h and 4 kW is L1e, a faster or more powerful two-wheeler is L3e, and a three-wheeler is L2e or L5e. Each class carries a different licence, a different type-approval test programme and a different insurance treatment, so a misdeclared category can stop a whole shipment at the Registration office. The full framework behind these classes is set out in our UN 38.3 and Lithium Battery Shipping Documents for Electric Two-Wheelers.
Why does the legal category matter more than the model name?
Type approval is granted to a specific vehicle type, and the category is part of that approval. When a registration authority reads a Certificate of Conformity, it uses the declared category to decide which driving licence is required, which insurance class applies, whether a helmet or a specific lighting set is mandatory, and whether the vehicle may use certain roads. Marketing terms such as city scooter, e-bike or cargo trike have no legal standing in that process.
The commercial consequence is straightforward. If a distributor orders a 45 km/h L1e scooter and receives a variant with an unlocked Controller capable of 70 km/h, the goods are not a faster version of the same product. They are a different legal vehicle, normally requiring an L3e approval, a Motorcycle licence and a different CoC. Returning or re-declaring that stock after import is far more expensive than checking the paperwork before the container ships.
- Licence class: L1e generally maps to an AM moped licence; L3e maps to A1, A2 or A3 depending on Continuous Power.
- Insurance: premiums and cover classes follow the category, not the retail name of the model.
- Market access: an approval for L1e cannot be used to register an L3e vehicle, even when the frame looks identical.
- Fleet rules: delivery operators often need L1e specifically so riders with a car or moped licence can be assigned.
How is a two-wheeled Electric Scooter classified?
For two wheels, the first split is the moped threshold. L1e covers vehicles with a maximum design speed of 45 km/h and continuous rated power up to 4 kW. L1e-A covers pedal-assisted mopeds, while L1e-B covers mopeds without pedals, which is where most electric kick-scooter-style and small seated scooters land. Anything above that speed or power ceiling moves into L3e.
L3e is then divided by continuous rated power into A1 (up to 11 kW), A2 (up to 35 kW with the power-to-weight limits applied) and A3 (above 35 kW). For electric Drivetrains, the relevant figure is continuous rated power, not the short peak power a controller can deliver for a few seconds. A supplier quoting a 6 kW peak figure for what is legally a 4 kW continuous L1e vehicle is describing the same hardware with a different number, and the CoC is the document that settles the question.
- Ask for continuous rated power as printed on the motor nameplate and repeated on the CoC.
- Treat peak power claims as performance marketing, not as a classification input.
- Check whether a speed limiter is part of the approved type or an accessory fitted later.
Where do three-wheelers and tuk-tuks fit?
Three wheels move the vehicle into L2e when it stays within the 45 km/h and 4 kW moped limits, or into L5e when it exceeds them. L5e-A is the passenger-carrying powered tricycle, while L5e-B is the version intended for goods, which is the class most cargo trikes and delivery three-wheelers fall into. A motorcycle with a sidecar is L4e, and four-wheeled quadricycles occupy L6e and L7e, split by unladen mass and power.
This matters particularly for the tuk-tuk and cargo segment. A passenger tuk-tuk and a cargo box trike may share a chassis, yet they are approved under different subcategories with different requirements for seating, restraint, lighting and load. Our JBJ5 EEC Tuk Tuk is an example of a three-wheeler whose documentation should be read against the L5e requirements, while the LZ2000 EEC electric motorcycle is a two-wheel L3e-style machine. Comparing the two shows why category has to be established model by model.
- L2e: three-wheel moped, 45 km/h and 4 kW ceiling.
- L5e-A: passenger tricycle; L5e-B: goods or cargo tricycle.
- L4e: motorcycle with sidecar; L6e/L7e: light and heavy quadricycles.
| Category | Configuration | Typical threshold | Practical consequence |
|---|---|---|---|
| L1e-A / L1e-B | Two-wheel moped, with or without pedals | 45 km/h, up to 4 kW continuous | AM licence; common class for urban 45 km/h scooters |
| L3e-A1 / A2 / A3 | Two-wheel motorcycle | Above 45 km/h or 4 kW; split at 11 kW and 35 kW continuous | A1/A2/A3 motorcycle licence; high-performance electric motorcycles |
| L2e | Three-wheel moped | 45 km/h, up to 4 kW | Low-speed three-wheelers and small delivery trikes |
| L5e-A / L5e-B | Powered tricycle, passenger / goods | Above the L2e thresholds | Tuk-tuks and cargo tricycles; seating or load requirements differ |
| L4e | Motorcycle with sidecar | Based on the base L3e vehicle | Approved as a separate configuration |
| L6e / L7e | Light / heavy quadricycle | Four wheels, mass and power limits | Rarely relevant to two- and three-wheeler importers |
Thresholds are simplified for buyer-side screening. Always confirm the exact Limits in the consolidated text of Regulation (EU) 168/2013 and the CoC for your variant.
What happens if the delivered specification changes?
Approvals are extended over time. When a manufacturer adds a larger battery, a different motor winding, a new wheel and tyre combination, a different brake supplier or a revised controller map, it applies for an extension to the original type approval. The CoC for each production vehicle then cites the extension that covers its exact configuration. The visible frame can stay identical while the legal variant changes completely.
The most common failure we see is a genuine approval for a lower-powered variant being presented for a higher-powered one, or a CoC whose battery capacity does not match the pack installed. Reconcile the CoC, the VIN plate, the motor nameplate and the battery label against a physical unit during pre-shipment inspection. If any one of them disagrees with the approved variant, registration can be refused even though the approval number itself is valid.
How should a buyer confirm the category before placing an order?
Start by requesting a scanned CoC from a recently produced vehicle of the same variant, not a generic brochure. Read the category field, the type-approval number, the continuous rated power, the maximum design speed, the mass and the Battery Specification. Then ask which approval authority issued the number and, where a national database is available, confirm it independently.
Next, register one sample vehicle in the destination country before committing to a container. A single pilot registration exposes problems with local interpretation, insurance and documentary format that no amount of email correspondence will reveal. Finally, make the declared category a line item in the purchase contract with a clear remedy if the delivered goods differ. That one clause is usually worth more than any test report in the appendix.
Frequently asked questions
Is an electric bicycle an L-category vehicle?
It depends on the specification. Pedal-assist cycles limited to 25 km/h and 250 W are generally treated as EPAC products outside the type-approval framework and follow product-safety rules instead. Once the vehicle exceeds those limits or can run on throttle alone without pedalling, it usually falls into the L-category and needs type approval. Check the destination country, because national interpretations differ.
Can an L1e scooter be derated and registered as an L3e?
Not by simply changing a setting. The category is part of the approved type and is declared on the CoC. A software limiter fitted after production does not change an approval, and modifying an approved vehicle can invalidate the CoC entirely. Order the variant whose CoC matches the category you intend to register.
Does wheel size affect classification?
Wheel and tyre combinations are part of the approved type, so a change can require an extension of the approval even when speed and power are unchanged. It is one of the specification items worth reconciling on the CoC and on the physical vehicle.
What is the difference between L5e-A and L5e-B?
L5e-A covers powered tricycles designed primarily for carrying passengers, while L5e-B covers those designed for goods. The distinction affects seating, restraint, bodywork and load-related requirements, and therefore the approval documents you should expect to see.
Who decides the category if the supplier and the importer disagree?
The approval authority that granted the type approval, and ultimately the national registration authority in the country of first registration. A commercial datasheet does not override the CoC, which is why resolve the question before shipment rather than at the registration desk.
Key takeaways
- Classification is driven by speed, continuous rated power and wheel count, never by the retail product name.
- L1e is the 45 km/h / 4 kW moped class; L3e covers faster two-wheelers split by continuous power; L5e covers powered tricycles.
- Continuous rated power on the CoC, not peak power in a brochure, is the number that decides the class.
- Approval extensions are variant-specific, so a new battery, motor, wheel or brake can change the legal identity of the vehicle.
- Register one sample locally before a volume order, and write the declared category into the purchase contract.
Getting classification right is the cheapest form of import risk control. Once the category is confirmed, the rest of the document review follows a predictable path: CoC, approval number, variant extension, VIN and battery paperwork. For the wider approval framework see UN 38.3 and Lithium Battery Shipping Documents for Electric Two-Wheelers; for the specific documents a registration office asks for see CE Marking vs EEC Homologation.
